Key Matter:
- Led by Llewellyn, Arnold & Porter is the long-standing trademark counsel to The Hershey Company, owner of the famous Hershey’s chocolate bar. Llewellyn has handled multiple 2023 TTAB proceedings for the client, including one recent opposition matter concerning the registration of ‘Zeershee’. Hershey argued that the registration would harm its well-known ‘Hershey’ mark which has been established in the US for nearly 130 years and that the two marks are likely to be pronounced identically. In May 2023, the TTAB terminated the ‘Zeershee’ mark in favour of Arnold & Porter’s client.
- Arnold & Porter, led by John Rynkiewicz, handles the global search, clearance, prosecution and filing for Eire Born Spirits’ Proper No. Twelve Irish whiskey products. The brand is popularised by its association with Conor McGregor, famed mixed martial arts champion and personality.
- Arnold & Porter, led by Chicago partner Christopher Renk, serves as primary IP counsel to famous sportswear brand Nike. Renk and the team manage litigious matters including trademark infringement and proceedings before the TTAB.
