Key Matter:

  • Lontex v Nike (E.D. Pa.). San Diego partner Ben Wagner served as lead trial counsel for Philadephia sports compression gear maker Lontex in a jury award of wilful trademark infringement and punitive damages against Nike.
  • The award followed successful pretrial rulings including defeating summary judgment and Daubert expert witness admissability motions. 
  • The jury awarded $507,000 in damages for Nike’s contributory infringement of Lontex’s ‘Cool Compression’ mark on athletic wear, increased to $791,000 by the judge.
