Firm overview:

From its beginnings as a Chofn division handling foreign-related patents, Foundin IP is now an independent full-service firm with over 160 employees. It assists clients with IP matters related to applications and registration; licensing and technology transfer; investigations and analysis; and dispute and litigation. The firm is also qualified to represent clients in filing new plant varieties applications (wood and grass).

Along with its Beijing headquarters, Foundin has branches across China, including in Tianjin, Chengdu, Shenzhen, Yanji and other cities. The firm has also expanded overseas with offices in Japan, the US, France, Germany and the UK.

Clients rely on Foundin’s expertise in the areas of mechanical engineering, telecommunications, biomedicine, and chemical material, and its attorneys’ multiple working languages.

Team overview:

Founding and managing partner Jin Xiangyun has a background in mechanics and is “committed to solving IP problems”. Having been responsible for Japanese and Korean clients in a previous role as partner for a well-known IP firm, Jin is very familiar with these two cultures and the unique requirements of businesses from the countries. He is regularly invited to conduct patent practice training for foreign clients and domestic lawyers and take part in discussions of important cases.

Also on the management team, Cao Huan has worked in IP since 2006 and her specialisms include mechanical engineering, automotive engineering, household appliances and semiconductor device fabrication.

Key matters:

  • Foundin represented an Italian machinery company in a patent enforcement lawsuit against a company from Shandong that was recently selected by the IP Division of the Supreme People’s Court as a Typical Case of the Week.
  • The firm successfully invalidated a critical Chinese patent in CAR-T therapy in May this year, which it said allows companies in the field to freely prepare and sell relevant products in the Chinese market, as well as serving as a reference to other patent offices.
