Avoiding the perils of collaboration
When there is a dispute about the ownership of IP between a Japanese corporation and a non-Japanese company, a Japanese court is likely to decide that the court has jurisdiction over the case insofar as the IP was made in Japan and that Japanese laws must be applied to rule the case. If a lawsuit is filed outside Japan, the foreign court will decide according to its own laws. If lawsuits are filed in two jurisdictions, both courts may decide that they have jurisdiction over the issue.
