  • The applicant applied to revoke Hummel’s figurative EUTM mark R 1424/2022-2, DEVICE OF TWO CHEVRONS POINTING TO THE RIGHT designated in 2005 for classes 3 (bleaching preparations etc), 18 (leather goods etc) and 25 (clothing, footwear, headgear; sports clothing etc) on the basis of non-genuine use for five years.
  • The Boards of Appeal concluded “the evidence as a whole shows use for the registered goods that fall within the scope of the appeal.” The appeal was dismissed and costs of EUR 550 were charged to the applicant.
