Key matters:

• Dompatent represented POSCO PLANTEC Co., a South Korean architectural and structural steels manufacturer, in a European Union trade mark (EUTM) Second Boards of Appeal hearing for the mark H2 PRG SYSTEM for classes 7 (Hyrdogen pressers) and 37 (installation, maintenance and repair of hydrogen gas charger).
• On 3 July 2023, the examiner raised an objection finding that the international registration designating the European Union trade mark is descriptive and devoid of any distinctive character. The examiner reasoned, among others, as follows.
• On 8 April 2024 The Boards of Appeal annulled the contested decision with respect to Class 7: Hydrogen fuel pumps for service stations, etc..
• Dompatent assisted Alpine Naturprodukte GmbH, a supplier of natural products from the Alpine Tyrol region, with multiple EUTM trademarks registrations in early 2024.
