Key matters:

  • Eisenführ Speiser represented PilePro GmbH, a producer and distributor of steel products and building materials based in Braunschweig in north central Germany and a division of Sheet Pile LLC of the United States, in a decision of the Second Board of Appeal of the European Union Intellectual Property Office.
  • The decision centred on the European Union trademarks (EUTM) application for the mark WADIT for class 17 goods (Caulking materials and weatherstripping compositions, caulking materials and weatherstripping compositions for sheet piling, sealing paints) by Georg Wall, the predecessor of SteelWall ISH GmbH.
  • On  21 June 2023 the Cancellation Division upheld the application by PilePro GmbH due to non use for revocation of the mark in its entirety. On 28 March 2024 the Cancellation Division dismissed an appeal by SteelWall ISH GmbH upholding the earlier finding of non-use and ordering it to bear the total amount of EUR 1 630 in respect of the cancellation.
  • In early 2024, Eisenführ Speiser assisted Sennheiser audio equipment group, and its Berlin-based subsidiary Georg Neumann GmbH, a manufacturer of high-quality professional microphones and headphones marketed under the Neumann brand, with several European Union trademarks (EUTM) registrations.
