• heyCurlz Proud & Unique (Figurative) vs. GOTCURLZ (Word) - Jonas filed an opposition based on chemical and consumer goods multinational Henkel AG’s European Union trade mark GOTCURLZ (word mark). The opposition was against Class 3 goods (Bleaching preparations etc) of Munich applicant Tamara Yanar’s EUTM heyCurlz Proud & Unique (figurative mark).
• The Opposition Division rejected the opposition entirely because: “The relevant public with a merely average level of attention will certainly be able to distinguish between the signs.” Henkal AG was ordered to bear the costs.
