The client argued that there would be a likelihood of confusion to its own trademark ‘Solv-X’ on the basis that there was high similarity between the marks and the goods and services.
• The client’s mark had been registered and used in the UK since 2007, while the applicant had registered its mark in 2021. Murgitroyd’s client succeeded in relation to classes 21 and 3 for products including cosmetic sponges and brushes, drinking cups, and hair care products. The applicant’s mark was refused for these goods.
