- Wilson Sonsini represented IBG in the closely watched case Brumfield v IBG. Plaintiff Brumfield sued IBG for alleged infringement of patents related to trading platform technology. On appeal, the parties disputed the calculation of damages based on foreign use of software that was “made” in the US. Ultimately, the US Court of Appeals for the Federal Circuit ruled that patent owners can recover reasonable royalty damages based on foreign activity.
