Key matters:

• In Crocs v Effervescent, on October 3, 2024, the US Court of Appeals for the Federal Circuit issued a precedential opinion ruling that a brand’s false claim of patent ownership in a product advertisement may give rise to a deceptive advertising claim under the Lanham Act. A Sullivan & Worcester client alert says, “this precedent could have significant implications for advertisers, as promotional materials touting patents may now face heightened scrutiny and could lead to potential legal repercussions”.

• Led by Llewellyn, Arnold & Porter is the long-standing trademark counsel to The Hershey Company, owner of the famous Hershey’s chocolate bar. Llewellyn has handled multiple TTAB proceedings for the client, including a pending opposition, filed on November 1, 2024, to the registration of the mark 5TH AVENUE by TWG Tea Company.
• Arnold & Porter, led by Chicago partner Christopher Renk, serves as primary IP counsel to famous sportswear brand Nike. Renk and the team manage litigious matters including trademark infringement and proceedings before the TTAB. Helen Hill Minsker, a senior counsel in the Chicago office, represents Nike in its pending Trademark Trial and Appeal Board opposition, filed on June 7, 2024, to the mark GODDESS OF VICTORY: NIKKE, owned by Shift Up Corporation.
