Lee & Hayes’ expertise in trademark litigation spans the country in district courts, appellate courts and administrative forums. As well as processing a high volume of work, the firm is regularly engaged in sophisticated matters with companies at the forefront of their industry.

Partner Rhett Barney leads the Trademark Practice Group and is an attorney at record for over 2,800 US federal trademark applications. His experience covers all areas of trademark practice and he has counselled clients through complex commercial and licensing transactions involving substantial trademark portfolios.
Associate Johanna Tomlinson has litigated and enforced trademark, copyright and patent matters for clients in various district courts. She is the firm’s primary drafter for UDRP (Uniform Domain Name Dispute Resolution Policy) complaints and responses, with a strong record of success, and represents clients in proceedings before the Trademark Trial and Appeal Board.
Key matters:
- Johanna Tomlinson secured a UDRP win for Spokane Hoopfest, which hosts “the world’s largest three-on-three basketball tournament”, that resulted in the contested nationalhoopfest.com domain name being transferred to the client. Tomlinson presented an out-of-the-box legal argument that the tribunal could look beyond the domain name itself and find bad faith based on the parties’ history and the results of the web page.
- Lee & Hayes is lead counsel for Good Meat Project in a federal district court lawsuit against Good Meat and Eat Just for trademark infringement and false advertising under the Lanham Act. The team includes Rhett Barney, Bob Carlson, Johanna Tomlinson and Caleb Hatch.
- City of Leavenworth v Projekt Bayern. Lee & Hayes represents City of Leavenworth in the successful resolution of use of ‘Leavenworth Oktoberfest’ relating to an annual event.
